Welcome to KithSports™ (“KithSports”, “we”, “us”, or “our”). These Terms of Service (“Terms”) form a legally binding agreement between you and KithSports and govern your access to and use of our website, athlete profiles, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Notice, our Acceptable Use & Community Guidelines, and our Data & Upload Policy.
1. Eligibility & Age Requirement
You must be at least 16 years old to create a KithSports account. Athletes who are 16 or 17 years old (minors) may only register with the verifiable consent of a parent or legal guardian, whose email address must be provided during sign-up. By registering as a minor, you confirm that your parent or guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly allow anyone under 16 to use the Service. If we learn that an account belongs to someone under 16, we will remove it.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date. You may not impersonate another person, create an account for someone else without authorization, or use the Service if you have previously been banned.
3. Public Profiles
The Service lets you publish a shareable athlete profile at a public URL. You control whether your profile is public or private in your settings. When your profile is public, anyone with the link can view the content you choose to display. Do not publish information you are not comfortable sharing publicly.
4. Content You Submit
You retain ownership of the videos, images, text, statistics, and other content you upload (“User Content”). By submitting User Content, you grant KithSports a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute it solely to operate and provide the Service. You represent that you own or have the rights to your User Content and that it does not violate any law or third-party right. Content handling is described further in our Data & Upload Policy.
5. Acceptable Use & Content Moderation
You agree to follow our Acceptable Use & Community Guidelines. KithSports uses automated content-moderation technology to review submitted text and images. Content that violates our guidelines—including hateful, harassing, sexual, violent, or otherwise offensive material—will be blocked automatically. Repeated or severe violations will result in the suspension or permanent ban of your account. We may also remove content or suspend accounts following user reports or manual review.
6. Subscriptions & Payments
KithSports offers a free tier and a paid Pro subscription ($9.99/month). Paid subscriptions are billed on a recurring monthly basis through our payment processor, Stripe, until cancelled. You can cancel at any time from the billing portal; your Pro benefits remain active until the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing with prior notice. The Team tier is offered by custom arrangement and is not billed through the site.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or our guidelines, or to protect the Service or other users. Upon termination, your right to use the Service ends immediately.
8. Disclaimers & Limitation of Liability
The Service is provided “as is” without warranties of any kind. KithSports does not guarantee any recruiting, admissions, or employment outcome. To the maximum extent permitted by law, KithSports will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use after changes take effect constitutes acceptance of the updated Terms.
